KELBY GSD STATEMENT OF GUARANTEE
Buyer should have the pup examined by a licensed veterinarian by the date provided for their 9 weeks shot. If the
vet should determine that the pup has a serious, disabling health flaw, we will refund the purchase price in full if
the pup is returned immediately. This is the ONLY situation in which a refund will be given. All pups are examined
before leaving Kelby GSD by our veterinarian and at least one stool sample run. Please bring a new sample to your vet upon
initial exam as any detected parasites are usually very easily treated.
We will gladly replace any pup with elbow, or hip, dysplasia as detected by the Orthopedic Foundation for Animals (OFA).
This means any dog receiving a "excellent", "good", or "fair" rating has passed the OFA exam. As we only replace for
genetic dysplasia, the x-rays should be taken and submitted before 26 months of age. Females that are bred before
the age of 24 months will not be guaranteed. You may submit your x rays to OFA at any age before 26 months. Should
your dog be found to have hips less than fair quality, Kelby GSD will replace your dog with one of equal purchase value, same
sex. You will be put on the list with others depositing from the same litter. This means if you want first
pick, you will have to get in line on a litter with no deposits, or will be placed in line behind others. No return
of your dog is required to receive replacement, just submit a copy of your spay or neuter receipt, and you AKC papers signed
over to me. You do have the option of returning your dog to me should you wish to do so. No replacement will be given if the
x-rays are not submitted to the OFA for evaluation. Replacements must be taken within one year of confirmation of condition.
Please be sure your vet KNOWS that this x ray would be sent in for OFA examination, as they need to put certain information
on the x ray for OFA to evaluate it! Not all x rays are created equal, be sure your vets office is familiar with the OFA process.
We will gladly replace any pup that suffers from the following serious congenital and disabling, hereditary defects: blindness,
deafness, heart defect, pancreatic enzyme disorder, von Willebrand’s ( a bleeding disorder characterized by a deficiency
of a clotting factor), perianal fistula, cancer, or severe disabling allergies. Any other defect found to be genetically based
must be proved by sellers veterinarian. This portion of the guarantee extends to 26 months, or at the discretion of the seller.
The guarantee entitles the buyer to a replacement pup as stated above. Replacement means just that, not a refund. If
you choose to engage in expensive testing and treatment, that is YOUR choice, and I am not obligated to help you pay for any
procedures by refunding money. Even if you indicate to me that you have intentions of breeding your dog, I do not cover
non debilitating defects that prevent you from breeding your dog. Only debilitating, life long serious defects are covered
at any time. When it is not clear that a defect is genetic in nature, replacement will only be given at the discretion
of Kelby GSD, and a return of the dog may be required to receive replacement.
Guarantee applies to the original purchaser only and is non-transferable. Seller will not be responsible for any veterinary
costs or transportation charges, including shipping, ever, at any time. All the terms stated above must be
met by the buyer, and at the buyers expense to qualify for a replacement. This is a binding and legal contract and both parties
enter into it when receipt is signed and or buyer takes the puppy from Kelby GSD. Any changes to this agreement must be put
in writing to be valid and will be noted on the receipt of sale. The guarantee is for a REPLACEMENT, not a MONEY back
guarantee. Deposits that are made on a puppy, or puppies, that the buyer chooses not to take delivery of are non-refundable,
but are transferable to another litter. In the event that a puppy is not received due to the sellers inability to deliver,
deposits will be refunded.
In the event that the buyer cannot keep this puppy at any time in the dogs life, and cannot find it a suitable home, buyer
should contact Kelby GSD to help them in placing this animal. Kelby dogs should never end up in a shelter.
An AKC application for registration will be provided as soon as I have them in my possession. Rarely are applications given
at the time of sale, but rather mailed when your pup has passed his initial vet exam. Buyers agree to use the Kelby name in
the registered name of the dog. Dogs not registered by their owners, and dogs not bearing the Kelby name as agreed will NOT
be guaranteed.
A word on temperament: Environment plays a huge part on a dogs final character. Each and every pup produced by Kelby is
felt to have left here with a good beginning character intact. Should a dog be found to have serious defect in character,
it would strictly be up to Kelby Kennels as to determine whether or not to offer up a replacement of this dog. NO replacement
in this case will be made without the dog being returned to Kelby at the buyers expense.
Only one replacement per family will ever be given. Owners must take some responsibility for the conditions
of their dogs, and many factors can contribute to defects besides genetics. Overweight and over excerisizing
both contribute to structual problems. Enviornmental pollutions and poor food ingredients can contribute to kidney,
liver, cancer conditons. this is why limiting one replacement per family should be perfectly reasonable. I
stand behind my dogs, and care about the future of you and your pet. I realize this guarantee is rather involved, but
it has been written, and rewritten to better protect myself, and the interests of Kelby puppy buyers. Breeding dogs
is not an exact science, and from time to time things go not as expected. This guarantee is an agreement as to how I
will hold up my end of things. Any disputes to this contract needing arbitration will be handled in the county
the kennel is located in.
